LEVEL 3 - DIPLOMA IN DEFENCE STRATEGIC EXPORT CONTROL COMPLIANCE

Next Course Date: TBC - July 2012

A programme combining an online, interactive, distance learning element and a one-day seminar. The online part takes approximately two hours to complete, including the online multiple-choice assessment. It includes a comprehensive guide to using the electronic material with access to external support if required. The one-day seminar is run by industry experts, incorporating the most current information and providing a practical assessment.

TARGET MARKET

This programme is appropriate for Export Control compliance staff who wish to ensure that their knowledge is current.

AIM:

The aim of the Level 3 programme is to provide a thorough understanding of UK and US export and trade controls and implications of non compliance. A further aim is to provide the capability to analyse a variety of export situations and identify a number of possible solutions.

PRESENTERS

David Hayes - Director - David Hayes Export Controls
David Hayes has many years experience in export controls, both from an industry and regulator’s perspective. In addition to his own consultancy, David is the Director of UK Affairs for the Washington DC based trade consultancy MK Technology.

David was, until early 2007, the Corporate Head of Export Controls for the Rolls-Royce Group, where he worked regularly with the Rolls-Royce Main Board and was instrumental in establishing the Board Exports Committee.

Prior to joining Rolls-Royce, David worked for TRW Aeronautical Systems (later Goodrich) where he was responsible for export compliance globally.

In 2007, recognising an increasing demand from industry, especially in relation to UK companies having to deal with US controls, he established his own consultancy. David provides services to a rapidly expanding international client base in a wide variety of industrial sectors, covering both dual-use and military products.

David is the founding Chairman of the Export Group for Aerospace and Defence (EGAD), the UK’s leading trade body on export controls, and a widely recognised expert in his field. He is a regular speaker at national and international export control events. David was also the UK export control subject matter expert for US Consultants Booz Allen Hamilton Inc on the Transatlantic Secure Collaboration Program (TSCP) Phase II. In addition, he is a guest lecturer on MSc programmes run by Nottingham and Southampton Universities and has recently been closely involved in developing export control training, which is offered jointly by Cranfield University and EGAD.

David is involved in many export control fora, both nationally and internationally, and has regularly given evidence to UK Parliamentary Select Committees on export control issues as well as writing regularly for professional publications. He is also a qualified Six-Sigma Green Belt.

David is also a qualified pilot and flies both fixed and rotary wing aircraft. He also spent ten years as an Intelligence Officer with 7006(VR) Intelligence Squadron of the Royal Auxiliary Air Force, specializing in Air Defence and Electronic Warfare and was a member of the Association of Old Crows.

Brinley Salzmann - Director Overseas & Exports - ADS
Brinley joined the Defence Manufacturers Association (DMA), at first on a temporary basis, in July 1985, having graduated from Sheffield University with a BA in Ancient History & Classical Civilisation. He worked for the DMA in a number of roles, before being appointed to the position of Exports Director in June 1999. In October 2009, on the creation of ADS through the merger of the DMA, APPSS and SBAC, he became the new organisation's Director, Overseas & Exports.

The vast majority of his work at present constitutes providing offset, industrial participation and export controls-related help, advice and assistance to British companies. In this capacity he acts as Secretary to the Export Group for Aerospace & Defence (EGAD), and the United Kingdom Offset Operations Group (UKOOG) special interest groups.

As Secretary to EGAD, he tries to provide help and advice to companies on export control matters and liaises closely with the Export Control Organisation (ECO)), Ministry of Defence (UK), Foreign & Commonwealth Office (FCO), Department For International Development (DFID) and Her Majesty's Revenue & Customs (HMRC), as well as with other Industry bodies and Non-Governmental Organisations (NGOs). He sits on a number of export control related groups, including the joint Government-Industry Export Control Advisory Committee (ECAC). He is also the Secretary of a Section 5 prohibited firearms special interest group, and the United Kingdom Offset Strategy Group (UKOSG). He is also a Member of the London Countertrade Roundtable (LCR).

Spencer Chilvers - Head of Civil Nuclear Export Control Compliance - Rolls Royce
Spencer Chilvers joined Rolls-Royce plc in June 2010 as part of the corporate export control team with special responsibility for export control policy and export control compliance in the civil nuclear business.

Prior to that he worked for 14 years for the Export Control Organisation (ECO) in the Department for Business, Innovation and Skills where he was Head of the International Policy Unit. During that time he was responsible for ECOs interests in the export control regimes, relations with the EU, including working groups dealing with dual-use items, trade sanctions and intra-community transfers of defence products. He was also involved in work towards an Arms Trade Treaty, on small arms and light weapons issues associated with the UN Programme of Action, the OSCE Document and the UN Firearms Protocol. He also participated in various UN Groups of Government Experts as the UK representative and was also active on international outreach work.

Susan Griffiths - Export Control Manager - MBDA UK Limited
Susan joined MBDA UK, a missile systems company in 1999 when they were called Matra BAe Dynamics a joint venture company between France and the UK. The formation of MBDA came with the integration of Italy in 2002 and more recently MBDA Germany and USA.

In her role as Export Control Manager she is responsible for all export control matters including licensing, training and awareness and compliance for all of MBDA UK. As well as Export control she is also responsible for UK Import licensing for Section 5 and Section 1 goods, Home Office approval and Firearms certificates. She also advises on European national legislation regarding the French, Italian, German Export Controls and US Export Controls and is active within the joint MBDA Export control group which seeks to harmonise export practices and develop best practice for the whole of MBDA.

Susan is a member of EGAD (Export Group for Aerospace and Defence) in the UK and is vice-chair person on the Executive committee. She also participates within some of EGAD's sub-committees which offer help and advice to other exporters and acts as a primary interface with the British Government Departments on export control issues. She is also part of an EADS Export Control working group in which she specifically advises on UK Trade Controls and a member of ASD –Aerospace and Defence Industries Association of Europe in Brussels.

Previous to joining MBDA Susan worked for Fujitsu for 10 years as an Export and Shipping manager and was responsible for dealing with multiple shipments to many destinations throughout the world, liaising with freight forwarders, letters of credit and all matters pertaining to customs.

She has a B.A. (Hons) in English from Leicester University.

Bernadette Peers -Compliance Manager - Strategic Shipping
Bernadette Peers joined the Department of Trade & Industry in 1996 as an Investigation Officer in the Legal Services Department with responsibility for investigating and prosecuting company fraud and bankruptcy fraud.

In 1999 she joined the Export Control Organisation as a Compliance Officer with responsibility for visiting and auditing companies to ensure compliance with existing legislation regarding export control and to offer advice and assistance where necessary.

In 2002 Ms Peers was promoted to Head of Communications Unit in the Export Control Organisation with responsibility for International Outreach; visiting a variety of countries and hosting their attendance to the UK; Domestic Outreach; providing seminars and workshops throughout the UK, and Management of the Awareness section with responsibility for the ECO Helpline and ECO website.

In 2004, she joined Strategic Shipping Limited as Compliance Manager with responsibility for assisting and training its clients to comply with export controls, in whichever country they are operating.

Ms Peers has spoken at the Society for International Affairs (SIA) conferences in the UK and USA; and has also spoken at the Partnering for Compliance Conference in 2006, 2007, 2008 and 2009.

Ms Peers has been Chair of the IBC Global Trade Controls events in London, Spoken at various EGAD meetings and given evidence to the Committee on Arms Export Controls as a member of EGAD.

Ms Peers is a member of the Export Group for Aerospace and Defence serving on the Compliance, Customs and Non Governmental Organisations (NGO’s) sub committees, and has attended and presented at the GRIP/COARM seminar in Brussels.

She assisted with the running of and presenting at “ITAR How to Cure the Virus” a joint ITAR venture with Squire Sanders & Dempsey in 2007. The 2008 event was adopted by EGAD and she assisted in the organization and presenting of this and the 2009 and 2010 events also.

Sue Tooze - Export Control Compliance Executive - BAE Systems
Sue joined BAE Systems in 2000, initially working in its Submarine Solutions business based in the North West. Following commercial roles in various ship and submarine projects, Sue became Submarines' Head of Commercial Central Services which included managing export contracting and export credit insurance and being the business's Export Control Coordinator.

Two years ago Sue moved to BAE Systems' Head Office in her current role of Export Control Compliance Executive. She is working closely with the business units' export control teams and with BAE Systems Inc. to drive organisational compliance with UK and US export control regulations and to promote transfer of best practice. Sue provides advice and support to the business on export control compliance issues and conducts annual compliance verification reviews of the business units.

LEVEL 4 - MSC ACCREDITED MODULE IN LEGAL, ETHICAL AND POLITICAL FRAMEWORKS OF DEFENCE WITH A FOCUS ON STRATEGIC EXPORT CONTROLS

LEVEL 4 RUNS ANNUALLY AND IS SCHEDULED FOR NOVEMBER 2011 (subject to change)

The level 4 programme can be taken as a 4-day non-assessed workshop, leading to a Certificate of Attendance, or a 5-day assessed workshop, leading to a Masters' level accredited module. This assessed option is one module within Cranfield's MSc in International Defence Marketing.

TARGET MARKET

This programme is appropriate those involved in export controls who wish to understand the context in which those controls operate. Participants need to be able to work at Masters' level.

AIM:

The aim of the Level 4 programme is to provide a comprehensive understanding of the legal and political frameworks in which defence institutions function. A further aim is for participants to have a critical awareness of the regulatory regimes affecting strategic exports, as well as the political pressures which underpin them.
